Terms of Service

The agreement between you and Zomler for use of our website and services, including acceptable use, the accuracy disclaimer for estimated metrics, and platform-compliance terms.
These Terms of Service (the “Terms”) are a legal agreement between you and Zomler, Inc. (“Zomler,” “we,” “us”) governing your access to and use of the Zomler website and services (the “Services”). Please read them carefully. By accessing or using the Services, you agree to these Terms.
01Acceptance of these terms
By creating an account, accessing, or using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization.
02Eligibility
You must be at least 13 years old (or the higher minimum age required in your country) to use the Services, and you must be able to form a binding contract. Some features require you to be at least 18.
03Description of the Services
Zomler provides analytics and verified profiles for creators, built from publicly available social-media data and, where a creator connects an account, from official platform APIs. Some metrics are computed directly from source data and others are modeled estimates (see the accuracy disclaimer below).
04Accounts and registration
You are responsible for the information you provide, for keeping your credentials confidential, and for all activity under your account. Notify us promptly of any unauthorized use.
05Subscriptions, billing, and refunds
Paid plans are billed in advance on a recurring basis and renew automatically until cancelled. You can cancel at any time, effective at the end of the current billing period. Except where required by law, fees already paid are non-refundable, including for partially used periods.
06Connecting third-party accounts
If you connect an Instagram, YouTube, or other third-party account, you authorize Zomler to access the data covered by the permissions you grant, and you confirm you have the right to connect that account. You may revoke access at any time through the source platform or your Zomler settings; your continued use of any connected account remains subject to that platform’s own terms.
07Acceptable use
You agree not to:
- Scrape, harvest, resell, or redistribute data obtained from the Services except as expressly permitted.
- Reverse-engineer, decompile, or attempt to derive source code, or circumvent rate limits or security measures.
- Use the Services to harass, stalk, or harm any person, or to violate any law or third-party right.
- Introduce malware or interfere with the integrity or performance of the Services.
- Misrepresent your identity or your authority to act on behalf of another party.
08Accuracy of estimated metrics
Estimated and modeled metrics are provided “as is.” Figures such as growth history, reach, audience demographics, benchmark comparisons, engagement estimates, and forecasts are derived from public data and statistical models. They are estimates only, may not be complete or accurate, and can change as source data changes. Do not rely on them as the sole basis for any decision. Metrics computed directly from source data are labeled as such in the product.
09Intellectual property
The Services, including their software, design, and content (excluding third-party and user data), are owned by Zomler and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms.
10Third-party services and platform compliance
Features that use third-party platforms are also governed by those platforms’ terms. When using Meta-sourced data you agree to the Meta Platform Terms, and when using YouTube-powered features you agree to the YouTube Terms of Service. Our handling of data from these platforms is described in our Privacy Policy.
11Customer data and roles
Where you use the Services to process personal data about other people (for example, a brand evaluating creators), you act as the data controller for that processing and Zomler acts as your processor, subject to any applicable data-processing agreement between us.
12Disclaimer of warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY METRIC WILL BE ACCURATE OR COMPLETE.
13Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZOMLER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
14Indemnification
You agree to indemnify and hold Zomler harmless from claims, damages, and expenses arising out of your use of the Services, your content, or your violation of these Terms or any law or third-party right.
15Term and termination
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Services. Provisions that by their nature should survive termination will survive.
16Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Delaware, unless a binding arbitration agreement applies. Nothing here limits any non-waivable rights you have under the mandatory law of your country of residence.
17Changes to these terms
We may update these Terms from time to time. Material changes take effect after we post them and update the “last updated” date; your continued use of the Services means you accept the revised Terms.
18Not affiliated with the platforms
Zomler is an independent service and is not affiliated with, endorsed by, or sponsored by Instagram, Meta Platforms, Inc., YouTube, or Google LLC. All product names, logos, and brands are the property of their respective owners and are used for identification only.
19Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. We may assign these Terms in connection with a merger or sale; you may not assign them without our consent. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and Zomler regarding the Services.
